Rules of Evidence for Investigators

The admissibility of evidence collected during an investigation can often be a deciding factor in the success or otherwise of a matter. It can be very demoralising for investigators who have invested significant time and effort into a matter to have it abandoned as a result of inadmissible evidence. It can also result in a waste of investigation resources, damage the credibility of the investigating agency, and embolden the rogue end of the regulated industry.

While the admissibility of evidence is ultimately up to the court to decide, there are actions that investigators can take to maximise the potential for evidence collected to be deemed admissible. This workshop will take you through these actions and how this can be incorporated into routine investigative practice, to ensure that investigated matters are judged on facts and not on technicalities.

How to ensure your briefs of evidence are court ready & can withstand attack – civil penalty & quasi-criminal briefs

An investigator or regulator’s role is to not only establish that a breach or an offence has occurred, but to ensure the evidence obtained and collected can be admitted into court and the conduct or offence proven. The workshop will address a summary of civil penalty and quasi-criminal proceedings and will delve into comparisons to conventional civil and criminal proceedings, disclosure and rules of evidence, standards of proof, strategic information gathering and compilation of briefs. It will be an opportunity to learn how to assess your own case’s strengths and weaknesses and how to think like a defendant’s lawyer in approaching the case.
