Overcoming complexity – using a risk-based approach to determine appropriate responses to non-compliance

Managing non-compliance within a regulated system is a complex task and involves diverse approaches with unintentional and low harm non-compliance addressed through education and support and high harm non compliance with stronger enforcement actions. Determining what is unintentional and low harm, and what is intentional and high harm is not straight forward.

For an organisation to be confident that regulatory resources are being effectively applied in accordance with their regulatory approach it must apply a consistent and accurate assessment process to all non-compliance issues.

This workshop will present a decision support approach implemented by a number of agencies to manage non-compliance within regulatory systems that delivers repeatable and defensible risk-based decisions.

  • Understand the importance of having a consolidated and consistent method of receiving and assessing reports of non-compliance with regulatory requirements
  • Learn about the value of having an effective mechanism to triage reports, based on immediacy of risk and potential imminent harm.

How to develop a consistent & defensible regulatory risk assessment framework

Risk based regulation identifies and prioritises high risk issues that need immediate attention from the low risk issues that can be addressed when time and resources permit. But how do you determine what is high risk and what is low risk in a consistent and defensible way?

This workshop will step through the theory of risk assessment, demonstrate how it is applied in a regulatory context, and why it can be a powerful communication tool for internal and external stakeholders. Participants will also have the opportunity to run the risk ruler over their own agency’s activities and develop their own high level regulatory risk assessment.
